MITSUBISHI HEAVY INDUSTRIES HOLIDAY VOUCHER PROMOTION - TERMS AND CONDITIONS

By entering into the ‘Mitsubishi Heavy Industries Holiday Voucher Promotion’ (“Competition”), you are agreeing to the following terms and conditions:
  1. Standard Terms:
    • Information on how to enter forms part of the terms and conditions of entry.
    • Entry into the promotion is deemed acceptance of these terms and conditions.
    • Headings in this document are included for ease of reference, and do not affect interpretation in any way.
    • The claimant is responsible for ensuring his or her familiarity with the Terms at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to a claimant or not) does not constitute a waiver of that restriction or of the Terms generally.
    • All claimants acknowledge that the Promoter can rely on these Terms even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded the holiday voucher to the ineligible person. Return of the holiday voucher or payment of its equivalent value to the Promoter may be required by the Promoter if this occurs.
    • The Promoter’s decision in relation to any aspect of these Terms and the Promotion is final and binding on every person who enters. No correspondence will be entered into.
  2. Who can participate?
    • The Promotion is only open to Australian residents aged 18 years or older, excluding (“In-Eligible Claimants”):
      • management, employees, directors and contractors of the Promoter, its related entities, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of the prizes);
      • persons who make purchases in the name of trusts, companies, businesses, commercial or residential developers, builders, subcontractors, installers or resellers;
      • the immediate family, which means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
      • persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter.
    • Consumers:
      • A bona fide purchaser of an Eligible Product for their own use, in their own property;
      • Purchases must be in the Claimant’s name only; and
      • Purchases must only be for domestic and residential use, and excludes purchases for resale to Consumers.
  1. Promoter Details:
    • The Promoter is Mitsubishi Heavy Industries Air-Conditioners Australia Pty Ltd (ABN 92 133 980 275) of 9C Commercial Road, Kingsgrove, NSW 2111(“Promoter”).
    • Outlets participating in the Promotion are stockists of eligible Mitsubishi Heavy Industries Air-Conditioners Australian products (as listed in the table below in “Eligible Products”) located in Australia and can be located on the website mhiaa.com.au(“Participating Outlets”).
  2. Duration:
    • Purchase Period:
      • Purchases for the Promotion must be made between 01/04/2017 and on 31/07/2017 inclusive (“Purchase Period”).
    • Redemption Period:
      • Claims in the Promotion must be submitted between 00:01 AEST on 01/04/2017 and 23:59 AEST on 31/08/2017 (“Redemption Period”).
  3. How to Claim and Enter:
    • Consumers:
      • To be eligible to claim the HOLIDAY VOUCHER and go into the draw for the major Consumer prize, the claimant must:
        • Purchase an eligible product from a Participating Outlet during the Purchase Period (Qualifying Purchase); and
        • During the Redemption Period, visit www.mhiaapromotion.com and follow the links to the Promotion Claim on-line form (Claim Form) and fully complete and submit the Claim Form by providing:
          • all details requested by the Promoter, including but not limited to, their first name, surname, contact phone number, postal address, email address and date of birth;
          • The claimant’s full contact details must correspond with what is printed on the tax invoice;
          • installation address of the Eligible Product purchased;
          • the model and serial number of the Eligible Product purchased (if the serial number is not shown on the tax invoice, refer to the Claim website for details on how to find the serial number on the unit);
          • the Participating Outlet where they purchased the Eligible Product;
          • the tax invoice number from their Qualifying Purchase (Tax Invoice); and
          • a scan or photograph of their Tax Invoice (paid in full) in a formatted accepted on the Claim Form.
    • All valid claims will automatically go into the draw to win a family trip for four (4) persons to Hawaii valued at AUD$22,500.00 (the ‘Consumer Prize’).
  4. Eligible Products:
    • Eligible Products are listed in the table below. The value of the HOLIDAY VOUCHER available to be claimed for each Eligible Product is referenced next to the respective product.

  1. Holiday Voucher Information:
    • HOLIDAY VOUCHER is redeemable only with Qantas Holidays. The value of the HOLIDAY VOUCHER will depend on the Eligible Product purchased and used for an Eligible Claim. Please refer to the table above for relevant HOLIDAY VOUCHER values.
    • The value of the HOLIDAY VOUCHER will be in AUD.
    • Eligible Claimants should allow four (4) weeks from the date of they submit their Eligible Claim to receive their HOLIDAY VOUCHER, providing their claim is valid.
    • Eligible Claimants must call Qantas Holidays direct line on 1300 858 874 to make bookings once the HOLIDAY VOUCHER has been issued.
    • All HOLIDAY VOUCHER value and associated rights and benefits expire at 23:59 on 31 August 2018.
    • The HOLIDAY VOUCHER must be used for Holiday packages including flights, accommodation, cruises, car hire and experiences. Please visit qantasholidays.com.au and contact Qantas Holidays on 1300 858 874 for more details.
    • Eligible Claimants must quote their booking reference number at time of redemption for their HOLIDAY VOUCHER.
    • The value of the HOLIDAY VOUCHER must be wholly redeemed in one transaction.
    • The HOLIDAY VOUCHERS are non-transferable, non-refundable and cannot be redeemed for cash. No responsibility is taken for lost, damaged or stolen vouchers.
    • All bookings and travel are subject to Qantas Holiday Voucher booking conditions.
  2. Verification:
    • Consumer claimants must retain their original Tax Invoice (Proof of Purchase) which corresponds to the claim they submit in the Promotion.
    • If requested by the Promoter, Eligible Claimants must produce, within the time requested by the Promoter at its absolute discretion:
      • appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim of the HOLIDAY VOUCHER and compliance with these Terms; and
      • Their Proof of Purchase that corresponds to all claims they have submitted in the Promotion.
    • If the items required by the Promoter are not received or a claimant has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the claim submitted by the claimant will be deemed invalid.
    • Claimants can only participate in the Promotion in their own name. Claimants who submit claims using multiple aliases (i.e. multiple names, addresses and/or email addresses) will be deemed ineligible to claim.
    • Claimants full contact details should correspond with what’s printed on the tax invoice or proof of sale for it to be valid. Therefore, tax invoices with NO contact details of the claimants will be deemed invalid.
  3. Prizes:
    • Consumer Prize:
      • There will be one (1) family trip to Hawaii (valued at $22,500.00) available to Consumer claimants, which includes:
        • return airfares to Hawaii for four (4) persons;
        • accommodation;
        • $5,000.00 spending money; and
        • airport transfers.
    • The following conditions apply to the Consumer Prize:
      • The nominated winner must provide the original copy of the tax invoice or proof of sale by 31 August 2017 to be eligible to claim for the Consumer Prize.
      • The winner is responsible for all expenses other than those specified in these Terms and Conditions.
      • The Consumer Prize is not transferable and non-refundable and must be accepted as awarded.
      • The Consumer Prize must be taken within one (1) year of receipt.
      • If the Consumer Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute with another Consumer Prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
      • If for any reason the winner does not claim or able to provide the correct documents by the time stipulated by the Promoter, then the Consumer Prize will be forfeited subject to these Terms and Conditions.
  4. The draw, draw scrutiny & redraw
    • Consumer Prize:
      • The draw for the Consumer Prize will be conducted at 201/117 Old Pittwater Road, Brookvale NSW 2100).
      • At 2.00pm AEST on 15 September 2017 the first valid entry will win the Consumer Prize (Draw).
      • The independent scrutineer’s decision is final and no correspondence will be entered into.
      • The winner of the Installer Reward Prize will be notified in writing within 2 (two) business days of the draw date and the winner’s name and state will be displayed on the website www.mhiaapromotion.com.
      • The winner of the Consumer Prize has until the 15 December 2017 to submit the original tax invoice or the proof of sale document to be able to claim their Consumer Prize. If the Consumer Prize is unclaimed after 15 December 2017 there will be a redraw for the unclaimed prize conducted by the Promoter for the unclaimed Consumer Prize. In such event, redraws will take place 15 January 2018 at the same time and place as the previous draws, subject to any directions from a regulatory authority. The redrawn winner will be notified in writing within 10 (ten) business days of the redraw and the winner’s name and postcode will be displayed on the websites www.mhiaapromotion.com.
  1. General
    • Any costs associated with accessing the Promotion website are the claimant’s sole responsibility and are solely dependent on the internet service provider used. Eligible Claimants must submit their claims manually using an internet browser.
    • The Promoter is not responsible for technical difficulties with the claim mechanism and does not warrant that the Promotion website will be available at all times.
    • The Promoter accepts no responsibility for any claims not received for any reason during the Claim Period. No responsibility will be taken for lost, late or misdirected claims.
    • The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically submit claims in the Promotion repeatedly is prohibited and will render all claims from the claimant invalid.
    • Incomplete, ineligible, indecipherable or incorrect claims will be deemed invalid.
    • Claims are deemed to be received at the time of receipt into the Promoter's database, not time of transmission by the claimant.
    • If more than one person attempts to claim the HOLIDAY VOUCHER, the Promoter has sole and absolute discretion to determine which of those persons the legitimate claimant is.
    • If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, network failure, tampering, unauthorized intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, including cancelling, terminating, modifying or suspending the Promotion.
    • Any claimant who, in the opinion of the Promoter, tampers or interferes with the claim mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the claim process, will be ineligible to claim.
    • All customer enquiries are to be direct to 1800 229 408 for Australian enquiries.
    • The:
      1. Promoter, the Promoter's related entities, the Participating Outlets and all agencies associated with the Promotion; and
      2. the employees, agents, directors and contractors, of all entities referred to in paragraph 2, shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of the HOLIDAY VOUCHER or Consumer Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
    • The Promoter accepts no responsibility for any tax liabilities that may arise from receiving the benefit of the HOLIDAY VOUCHER or the Consumer Prize.
    • CAUTION:Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
  2. Personal Information
    • All claims become the sole property of the Promoter.
    • All information claimants provide(“Personal Information”) will be used by the Promoter for the purpose of administering this Promotion, verifying claimants and awarding the HOLIDAY VOUCHER or the Consumer Prize.
    • Should a claimant’s Personal Information change during the Promotion Period, it is the claimant’s responsibility to notify the Promoter by email to info@mhiaapromotion.com
    • The Promoter may disclose claimants’ Personal Information to its contractors and agents to assist in conducting this Promotion.
  3. Opting-In to hear from the promoter
    • Should a claimant consent to receiving future information from the Promoter, via placing a tick in the ‘Opt In’ box featured on the Claim Form, information provided by the claimant may be entered into a database and may be used by the Promoter, the Promoter's related entities, and agencies engaged by the Promoter, for the Promoter's current and future promotional and marketing purposes without further reference or compensation to the claimant.
    • Claimants who elect to ‘Opt In’ may request to update or correct their Personal Information held by the Promoter and/or may request that they not receive further Promotional or marketing communications from the Promoter at any time by contacting the Promoter at the address noted in paragraph 6 or by electing to ‘Opt Out’ by using the ‘Opt Out’ function on any marketing materials received.
  4. Privacy Policy
    • Claimants may view the Promoter’s privacy policy by visitinghttps://mhiaa.com.au/index.php/about-us/privacy-policy-terms-of-use. The privacy policy details how a privacy complaint can be made.
    • The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (The Privacy Amendment (Enhancing Privacy Protection) Act 2012) as well as any other applicable laws.
  1. Promoter’s Rights:
    • If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
      1. to disqualify any entrant; or
      2. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
    • All entries become the property of the Promoter.
  1. Limitation of liability and variation of terms:
    • In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoters’ ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoters may in their absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation.
    • Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory Consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar Consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
    • Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition, including but not limited to the following:
      • any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
      • any theft, unauthorised access or third party interference;
      • any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  1. any tax liability incurred; or
  2. the use or enjoyment of the Prizes.
  • The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (“Promotion Parties”) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of the Major Prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (“Damages”) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.

HOW IT WORKS

  1. If you have participated to the last Summer Cash Back Promotion, you are automatically registered for this Promotion.
    However please ensure your details are still correct: GO ONLINE to mhiaapromotion.com and click on Installer's Access. You can use the same email as your login and password to connect to your account.
  2. If you are interested in registering for this Installer Reward program, simply got to mhiaapromotion.com and click on Installer's Access to create an account.
  3. From a April to 31 july 2017, your customers must redeem their Holiday Voucher online, upload their invoice and provide your company details (from the invoice).
  4. Once your customer's claim is approved you will then receive an email advising that you are entitled to a Reward. Lead-time: 4 to 6 weeks approval process.
  5. You pick a Prize Reward OR a Cash Reward and can redeem immediately or keep saving to get a higher value reward on the next installatiom job(s).
    So, the more MHIAA units you install, the bigger the prize! It's as simple as that!
  6. You can go ONLINE anytime through out the promotion to check the value of the reward(s) you are entitled to get and the list of customers that nominated you.

    • The claimant is responsible for ensuring his or her familiarity with the Terms at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to a claimant or not) does not constitute a waiver of that restriction or of the Terms generally.
    • All claimants acknowledge that the Promoter can rely on these Terms even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded the holiday voucher to the ineligible person. Return of the holiday voucher or payment of its equivalent value to the Promoter may be required by the Promoter if this occurs.
    • The Promoter’s decision in relation to any aspect of these Terms and the Promotion is final and binding on every person who enters. No correspondence will be entered into.
  2. Who can participate?
    • The Promotion is only open to Australian residents aged 18 years or older, excluding (“In-Eligible Claimants”):
      • management, employees, directors and contractors of the Promoter, its related entities, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of the prizes);
      • persons who make purchases in the name of trusts, companies, businesses, commercial or residential developers, builders, subcontractors, installers or resellers;
      • the immediate family, which means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
      • persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter.
    • Consumers:
      • A bona fide purchaser of an Eligible Product for their own use, in their own property;
      • Purchases must be in the Claimant’s name only; and
      • Purchases must only be for domestic and residential use, and excludes purchases for resale to Consumers.
  1. Promoter Details:
    • The Promoter is Mitsubishi Heavy Industries Air-Conditioners Australia Pty Ltd (ABN 92 133 980 275) of 9C Commercial Road, Kingsgrove, NSW 2111(“Promoter”).
    • Outlets participating in the Promotion are stockists of eligible Mitsubishi Heavy Industries Air-Conditioners Australian products (as listed in the table below in “Eligible Products”) located in Australia and can be located on the website mhiaa.com.au(“Participating Outlets”).
  2. Duration:
    • Purchase Period:
      • Purchases for the Promotion must be made between 01/04/2017 and on 31/07/2017 inclusive (“Purchase Period”).
    • Redemption Period:
      • Claims in the Promotion must be submitted between 00:01 AEST on 01/04/2017 and 23:59 AEST on 31/08/2017 (“Redemption Period”).
  3. How to Claim and Enter:
    • Consumers:
      • To be eligible to claim the HOLIDAY VOUCHER and go into the draw for the major Consumer prize, the claimant must:
        • Purchase an eligible product from a Participating Outlet during the Purchase Period (Qualifying Purchase); and
        • During the Redemption Period, visit www.mhiaapromotion.com and follow the links to the Promotion Claim on-line form (Claim Form) and fully complete and submit the Claim Form by providing:
          • all details requested by the Promoter, including but not limited to, their first name, surname, contact phone number, postal address, email address and date of birth;
          • The claimant’s full contact details must correspond with what is printed on the tax invoice;
          • installation address of the Eligible Product purchased;
          • the model and serial number of the Eligible Product purchased (if the serial number is not shown on the tax invoice, refer to the Claim website for details on how to find the serial number on the unit);
          • the Participating Outlet where they purchased the Eligible Product;
          • the tax invoice number from their Qualifying Purchase (Tax Invoice); and
          • a scan or photograph of their Tax Invoice (paid in full) in a formatted accepted on the Claim Form.
    • All valid claims will automatically go into the draw to win a family trip for four (4) persons to Hawaii valued at AUD$22,500.00 (the ‘Consumer Prize’).

  1. Holiday Voucher Information:
    • HOLIDAY VOUCHER is redeemable only with Qantas Holidays. The value of the HOLIDAY VOUCHER will depend on the Eligible Product purchased and used for an Eligible Claim. Please refer to the table above for relevant HOLIDAY VOUCHER values.
    • The value of the HOLIDAY VOUCHER will be in AUD.
    • Eligible Claimants should allow four (4) weeks from the date of they submit their Eligible Claim to receive their HOLIDAY VOUCHER, providing their claim is valid.
    • Eligible Claimants must call Qantas Holidays direct line on 1300 858 874 to make bookings once the HOLIDAY VOUCHER has been issued.
    • All HOLIDAY VOUCHER value and associated rights and benefits expire at 23:59 on 31 August 2018.

    • Eligible Claimants must quote their booking reference number at time of redemption for their HOLIDAY VOUCHER.
    • The value of the HOLIDAY VOUCHER must be wholly redeemed in one transaction.
    • The HOLIDAY VOUCHERS are non-transferable, non-refundable and cannot be redeemed for cash. No responsibility is taken for lost, damaged or stolen vouchers.
    • All bookings and travel are subject to Qantas Holiday Voucher booking conditions.
  2. Verification:
    • Consumer claimants must retain their original Tax Invoice (Proof of Purchase) which corresponds to the claim they submit in the Promotion.
    • If requested by the Promoter, Eligible Claimants must produce, within the time requested by the Promoter at its absolute discretion:
      • appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim of the HOLIDAY VOUCHER and compliance with these Terms; and
      • Their Proof of Purchase that corresponds to all claims they have submitted in the Promotion.
    • If the items required by the Promoter are not received or a claimant has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the claim submitted by the claimant will be deemed invalid.
    • Claimants can only participate in the Promotion in their own name. Claimants who submit claims using multiple aliases (i.e. multiple names, addresses and/or email addresses) will be deemed ineligible to claim.
    • Claimants full contact details should correspond with what’s printed on the tax invoice or proof of sale for it to be valid. Therefore, tax invoices with NO contact details of the claimants will be deemed invalid.
  3. Prizes:
    • Consumer Prize:
      • There will be one (1) family trip to Hawaii (valued at $22,500.00) available to Consumer claimants, which includes:
        • return airfares to Hawaii for four (4) persons;
        • accommodation;
        • $5,000.00 spending money; and
        • airport transfers.
    • The following conditions apply to the Consumer Prize:
      • The nominated winner must provide the original copy of the tax invoice or proof of sale by 31 August 2017 to be eligible to claim for the Consumer Prize.
      • The winner is responsible for all expenses other than those specified in these Terms and Conditions.
      • The Consumer Prize is not transferable and non-refundable and must be accepted as awarded.
      • The Consumer Prize must be taken within one (1) year of receipt.
      • If the Consumer Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute with another Consumer Prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
      • If for any reason the winner does not claim or able to provide the correct documents by the time stipulated by the Promoter, then the Consumer Prize will be forfeited subject to these Terms and Conditions.
  4. The draw, draw scrutiny & redraw
    • Consumer Prize:
      • The draw for the Consumer Prize will be conducted at 201/117 Old Pittwater Road, Brookvale NSW 2100).
      • At 2.00pm AEST on 15 September 2017 the first valid entry will win the Consumer Prize (Draw).
      • The independent scrutineer’s decision is final and no correspondence will be entered into.
      • The winner of the Installer Reward Prize will be notified in writing within 2 (two) business days of the draw date and the winner’s name and state will be displayed on the website www.mhiaapromotion.com.
      • The winner of the Consumer Prize has until the 15 December 2017 to submit the original tax invoice or the proof of sale document to be able to claim their Consumer Prize. If the Consumer Prize is unclaimed after 15 December 2017 there will be a redraw for the unclaimed prize conducted by the Promoter for the unclaimed Consumer Prize. In such event, redraws will take place 15 January 2018 at the same time and place as the previous draws, subject to any directions from a regulatory authority. The redrawn winner will be notified in writing within 10 (ten) business days of the redraw and the winner’s name and postcode will be displayed on the websites www.mhiaapromotion.com.
  1. General
    • Any costs associated with accessing the Promotion website are the claimant’s sole responsibility and are solely dependent on the internet service provider used. Eligible Claimants must submit their claims manually using an internet browser.
    • The Promoter is not responsible for technical difficulties with the claim mechanism and does not warrant that the Promotion website will be available at all times.
    • The Promoter accepts no responsibility for any claims not received for any reason during the Claim Period. No responsibility will be taken for lost, late or misdirected claims.
    • The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically submit claims in the Promotion repeatedly is prohibited and will render all claims from the claimant invalid.
    • Incomplete, ineligible, indecipherable or incorrect claims will be deemed invalid.
    • Claims are deemed to be received at the time of receipt into the Promoter’s database, not time of transmission by the claimant.
    • If more than one person attempts to claim the HOLIDAY VOUCHER, the Promoter has sole and absolute discretion to determine which of those persons the legitimate claimant is.
    • If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, network failure, tampering, unauthorized intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, including cancelling, terminating, modifying or suspending the Promotion.
    • Any claimant who, in the opinion of the Promoter, tampers or interferes with the claim mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the claim process, will be ineligible to claim.

    • The:
      1. Promoter, the Promoter’s related entities, the Participating Outlets and all agencies associated with the Promotion; and
      2. the employees, agents, directors and contractors, of all entities referred to in paragraph 2, shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of the HOLIDAY VOUCHER or Consumer Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
    • The Promoter accepts no responsibility for any tax liabilities that may arise from receiving the benefit of the HOLIDAY VOUCHER or the Consumer Prize.
    • CAUTION:Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
  2. Personal Information
    • All claims become the sole property of the Promoter.
    • All information claimants provide(“Personal Information”) will be used by the Promoter for the purpose of administering this Promotion, verifying claimants and awarding the HOLIDAY VOUCHER or the Consumer Prize.
    • Should a claimant’s Personal Information change during the Promotion Period, it is the claimant’s responsibility to notify the Promoter by email to info@mhiaapromotion.com
    • The Promoter may disclose claimants’ Personal Information to its contractors and agents to assist in conducting this Promotion.
  3. Opting-In to hear from the promoter
    • Should a claimant consent to receiving future information from the Promoter, via placing a tick in the ‘Opt In’ box featured on the Claim Form, information provided by the claimant may be entered into a database and may be used by the Promoter, the Promoter’s related entities, and agencies engaged by the Promoter, for the Promoter’s current and future promotional and marketing purposes without further reference or compensation to the claimant.
    • Claimants who elect to ‘Opt In’ may request to update or correct their Personal Information held by the Promoter and/or may request that they not receive further Promotional or marketing communications from the Promoter at any time by contacting the Promoter at the address noted in paragraph 6 or by electing to ‘Opt Out’ by using the ‘Opt Out’ function on any marketing materials received.
  4. Privacy Policy
    • Claimants may view the Promoter’s privacy policy by visitinghttps://mhiaa.com.au/index.php/about-us/privacy-policy-terms-of-use. The privacy policy details how a privacy complaint can be made.
    • The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (The Privacy Amendment (Enhancing Privacy Protection) Act 2012) as well as any other applicable laws.
  1. Promoter’s Rights:
    • If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
      1. to disqualify any entrant; or
      2. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
    • All entries become the property of the Promoter.
  1. Limitation of liability and variation of terms:
    • In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoters’ ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoters may in their absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation.
    • Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory Consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar Consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
    • Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition, including but not limited to the following:
      • any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
      • any theft, unauthorised access or third party interference;
      • any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  1. any tax liability incurred; or
  2. the use or enjoyment of the Prizes.
